Import Licensing Notes


Import of the milk products, chocolates products (including candies/confectionery/food preparations with milk or milk solids as an ingredient) from China is 'Prohibited' till 23rd June 2016 or until further orders, whichever is earlier. The transitional arrangements under para 1.5 of the Foreign Trade Policy will not be allowed in the case of import of above products from China for this period.

Sugar Duty History


Sugar duty raised to 10% from Nil for S Nos 76, 77 and 78 by 45/13.07.2012; Duty raised to 15% from 10% by 34/08.07.2013.

Sugar prices of rising once again. The Government has extended the duty free dispensation for sugar for a period of three months, that is, till 1 April 2011. It may be recall that the original exception lapsed on 31 December 2010. The period of 1 January to 7 January 2011 in which the exception was not available will be considered as "dead period". The schedule rate of 60% is applicable in this week.


The short period of three months of the exemption is difficult to understand since the domestic prices will only rise from April onwards with the end of sugar season. In our view importers should  be encouraged to establish long term contracts. The Government should be exempt sugar at least till the next sugar season in October 2011.


In the notification issued on 8 January 2011 the wordings of the amendments as well as the conditions are the same as those in the previous dispensation.


Zero duty withdrawn. Basic duty of five percent imposed by 15/28.04.98. Full exemption of countervailing duty also withdrawn by 15/28.04.98. This was followed by compulsory registration of contracts with APEDA by a Commerce Ministry notification on 1 September 1998. Basic customs duty revised upwards 20% from 5% by amending notification 05/14.01.99. Further raised to 40% from 25% by amending notification 139/30.12.99.


A notification on issued on 09 February to raise the schedule rate of sugar from 40 percent to 60 percent under the emergency powers of section 8A(1) of Customs Tariff Act 1975. A special cabinet approval was taken for the decision. In the Budget 200-2001. Import requirements are being met on the advance licence duty free route. [Editor/01.07.2009]


Procedure for Processing of Imported Raw Sugar by Job Workers

Subject: Procedure for processing of raw sugar into refined sugar by the job workers of importers.


Full exemption from basic customs duty is available to raw sugar imported by sugar factories or refineries in terms of S. No. 38B of Notification No. 21/2002-Customs, dated 1-3-2002. Such imports of customs equivalent to Central Excise duty payable on sugar manufactured domestically. Exemption under this entry is also available to imports of raw sugar made by any person who produces a valid contract with a sugar factory or refinery for its refining subject to the fulfillment of certain conditions.


Sugar Exports Requires Release Order from Directorate of Sugar against Advance Licence Raw Sugar

The transitional arrangements under para 1.5 of the Foreign trade Policy 2004-09 will not be allowed in the case of import of above products from China for this period. (This Import licensing note is added by DGFT NOTIFICATION No 67/2008, dated : 01-12-2008)
