Amendments in Exim Policy
Notification No. 27 dated 16th
September 1999
In
exercise of powers conferred by section 5 of the Foreign Trade
(Development and Regulation) Act, 1992
(No. 22 of 1992) read with paragraph 1.3 of the Export and Import Policy,
1997-2002 (incorporating amendment
made upto 31.3.99), the Central Government hereby makes following amendments in
the Export and Import Policy, 1997-2002: (incorporating
amendment made upto 31.3.99).
The
following shall be added as paragraph 9.9 (e):
"EOU/ EPZ/ EHTP/ STP units may be permitted to sell finished
products which are either freely importable under the Policy, or against other
import licences, in the DTA, over and above the levels permissible under
sub-paragraph (b) above, against
payment of full duties, on annual basis, provided they have achieved the
stipulated NFEP and export performance".
Paragraph
9.10 may be amended to read as follows:
The following supplies in DTA shall be counted towards fulfilment of
export performance and NFEP:
Paragraph
9.10 (f) may be added after paragraph 9.10 (e) to read as under:
Supply of goods to Defence and internal security forces provided they are
entitled for duty free imports of such items in terms of general exemption
notification issued by Ministry of Finance.
Paragraph
9.17 (c) shall be amended to read as under:
Export of finished goods direct from the job worker�s premises may be
permitted provided the job worker�s premise is registered with the Central
Excise Department. However, export of such products from the job worker�s
premises shall not be allowed through third parties as provided under paragraph
9.11 of the Policy.
The
following shall be added as paragraph 9.17 (e) after paragraph 9.17 (d).
The scrap/ wastes/ remnants generated at the job worker�s premises may
be either cleared from the job worker�s premises on payment of duty or return
to the supplying unit.
In Appendix-1, the item floriculture appearing in product group at III (i)
stands deleted and the item III (ii) may be modified as Bio technology and
floriculture.
Paragraph
10.2 (h) of the Exim Policy shall be amended to read as under:
Supply of marine freight containers by 100% EOU
(domestic freight containers-manufacturers) provided the said containers
are exported out of India within 6 months or such further period as permitted by
the Customs."
Paragraph
4.23 may be amended to read as:
"All Export House, Trading House, Star
Trading House and Super Star Trading House, Service Export House, International
Service Export House, International Star Service Export House, International
Super Star Service Export House, manufacturer exporter exporting more than 50%
of their production, subject to a minimum export of Rs.1 crore, and service
providers rendering services in free foreign exchange for more than 50% of their
services turnover subject to a minimum value of Rs.35 lakhs in free foreign
exchange in the preceding year, shall be issued a green card by DGFT. This card
will entitle the holder to such facilities as may be specified from time to
time".
