Notification No.89/ 2011-Customs

G.S.R. ----- (E). - In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments, in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No.39/96-Customs, dated the 23^rd July, 1996, published in Gazette of India, Extraordinary part II, Section 3, Sub-section (i) vide G.S.R. 291(E), dated the 23^rd July, 1996, namely:-

In the said notification, in the TABLE,

1. against S.No.2, in column (2), for the words “ Indian Navy” the words, “Indian Navy or Central Para Military Forces” shall be substituted;
   
   
2. against S.No.8,-
   
   
   1. in column (2), for the words “Ministry of Defence”, the words “Ministry of Defence or Ministry of Home Affairs” shall be substituted
      
      
   2. In column (3), for the words “Under Secretary to the Government of India in the Ministry of Defence” and “said Under Secretary”, the words “Under Secretary to the Government of India in the Ministry of Defence or Joint Secretary to the Government of India in the Ministry of Home Affairs, as the case may be” and “said Under Secretary or said Joint Secretary, as the case may be” shall respectively be substituted;
      
      
3. against S.No.10, in column (3), -
   
   
   1. in clause (b), in sub-clause (1), for the words “Ministry of Defence” , the words “Ministry of Defence or Ministry of Home affairs, as the case may be” shall be substituted;
      
      
   2. in clause (2), sub-clause (iii), for the words “Ministry of Defence” , the words “Ministry of Defence or Ministry of Home affairs, as the case may be” shall be substituted;
      
      
4.  against S.No.11, in column (3),-
   
   
   1. in clause (a), for the words” for use in anti-smuggling operations”, the words, “ for use in anti smuggling operations or coastal security operations or internal security operations” shall be substituted;
   
   
   2. for clause (b),the following shall be substituted, namely,-
      
   
   “(b) the importer produces a certificate,-
   
   
   1. from the Under Secretary to the Government of India in the Department of Revenue that the said goods are intended for use in anti-smuggling operations or
   
   
   
   2. from an officer not below the rank of Joint Secretary to the Government of India, in the Ministry of Home Affairs that the said goods are intended for use in coastal security operations or internal security operations.”
      
      
5. against S.No.12, in column (3), for the words “ Central Reserve Police Force”, the words “Central Para Military Forces” shall be substituted;

Note:- The principal notification No.39/96-Customs dated the 23^rd July, 1996 was published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) vide number G.S.R. 291 (E), dated the 23^rd July,1996 and last amended vide notification No. 64/2011-Customs dated the 19^th July,2011, published in Gazette of India, Extraordinary part II, Section 3, Sub-section (i) vide vide number G.S.R.550 (E), dated the 19^th July,2011.
