Anti-dumping duty: Acrylic fibre originating export from USA,
Thailand and Korea RP
This notification has been rescinded by the
notification of the Govt. of India in the Ministry of Finance (Department of
Revenue) No. 87 dated 8th June 2000.
Whereas
in the matter of import of acrylic fibre falling under Chapter 55 of the First
Schedule to the Customs Tariff Act, 1975(51 of 1975 and which is of USA,
Thailand or Korea RP origin, the designated authority vide its preliminary
findings, published in Part I, Section I of the Gazette of India Extraordinary,
dated the 1st April, 1997, had come to the conclusion that-
(i)
Acrylic fibre of USA, Thailand and Korea RP origin has been exported to
India below its normal value;
(ii)
the Indian industry has suffered material injury;
(iii)
the injury has been caused by the imports from USA, Thailand and Korea RP
And
whereas on the basis of the aforesaid findings of the designated authority the
Central Government has imposed provisional anti-dumping duty vide notification
of the Government of India in the Ministry of Finance (Department of Revenue),
No.38/97-Customs, dated 25.04.97 [G.S.R. 232 (E), dated the 25th
April, 1997] published in Part II, Section 3, Sub-section (I) of the Gazette of
India, Extraordinary, dated 25th April 1997.
And
whereas the designated authority vide notification no.47/ADD/IW, published in
part I, Section I, of the Gazette of India Extraordinary, dated the 14th
October, 1997 has arrived at the final finding that-
(i)
Acrylic fibre originating in or exported from USA, Thailand and Korea RP
has been exported to India below its normal value;
(ii)
The domestic industry has suffered material injury;
(iii)
The injury has been caused to the domestic industry by the exports
originating in or exported from USA, Thailand and Korea RP
Now,
therefore, in exercise of the powers conferred by sub-section (1) of Section 9A
of the Customs Tariff Act, 1975 (51 of 1975) read with rules 18 and 20 of the
Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty
on Dumped Articles and for Determination of Injury) Rules 1995, the Central
Government on the basis of the aforesaid final finding of the designated
authority, hereby imposes on the said acrylic fibre, when originating in or
exported from the country specified in column (2) of the Table hereto annexed,
by the exporters mentioned in the corresponding entry in column (3) of the said
Table, and imported into India, anti-dumping duty at the rate specified in the
corresponding entry in column (4) of the said Table:
Provided that nothing contained in this notification
shall apply to 1.7denier colour acrylic fibre, originating in or exported from
the United States of America by Cytec Industries Inc., USA or Stering Fibres
Ltd., USA.

The
anti-dumping duty imposed under this notification shall be levied with effect
from the date of imposition of provisional duty.
