Anti-dumping Duty: Seamless tubes or Seamless pipes exports originating
from Austria, Czech Republic, Russia, Romania and Ukraine
This notification has been
rescinded by the notification no. 92 dated 21st June 2000 of Government of
India in the Ministry of Finance (Department of Revenue).
WHEREAS in the matter of import of
seamless tubes or seamless pipes falling under heading or sub-heading Nos.
73.04, 7304.10, 7304.29 and 7304.39 of the First Schedule to the Customs Tariff
Act, 1975(51 of 1975), originating in, or exported from, Austria, Czech
Republic, Russia, Romania and Ukraine, the Designated Authority vide its
preliminary findings, published in the Gazette of India, Extraordinary, Part l,
Section 1, dated the 10th November, 1999 has come to the conclusion
that: -
(a) Seamless tubes or seamless
pipes originating in, or exported from Austria, Czech Republic, Russia, Romania
and Ukraine have been exported to India below its normal value, resulting in
dumping;
(b) the domestic industry has suffered material injury;
(c) injury has been caused by the imports from the subject countries.
Now,
therefore, in exercise of the powers conferred by sub-section (2) of section 9A of the Customs Tariff Act, 1975 (51 of 1975), read with rule 13 and rule 20 of
the Customs Tariff (Identification, Assessment and Collection of Anti-dumping
Duty on Dumped Articles and for Determination of Injury) Rules 1995, the Central
Government, on the basis of the findings of the Designated Authority hereby
imposes on seamless tubes or seamless pipes of the following description,
namely: -
(a) seamless tubes, of iron or steel, not cold
rolled, hot finished, of an external diameter not exceeding 273 mm or 10 inches
NB also known as boiler pipes or line pipes used in hydrocarbon industry,
processing and general engineering industry;
(b) casing and tubing of a kind used in drilling of oil or gas of an
external diameter not exceeding 244.5 mm or 9.5/8 inches;
falling under heading or
sub-heading Nos. 73.04, 7304.10, 7304.29 and 7304.39 of the First Schedule to
the said Customs Tariff Act, 1975(51 of 1975), originating in, or exported from,
Austria, Czech Republic, Russia, Romania and Ukraine, when exported by the
exporter mentioned in column (2) of the Table annexed hereto and imported into
India, an anti-dumping duty at the rate which is equivalent to the amount per
metric tone mentioned in the corresponding entry in column (3) of the said
Table.
