Export of fodder including wheat and rice straw

Policy Circular No. 36 dated 22nd December 2000

1.     Attention is invited to the entry at Code No. 2302 Table B of Schedule 2 of the book titled �ITC (HS) Classifications of Export and Import Items, 1997-2002� (incorporating amendments made upto 31st August, 1998) prescribing the conditions for export of �Fodder including wheat and rice straw�.

2.     The issue of export of above item was considered in consultation with Ministry of Agriculture and Co-operation (Deptt. of Animal Husbandry and Dairying) and in this connection it has been decided by the Director General of Foreign Trade that the following procedural guidelines may be followed for export of above items: -

(i)       export of wheat/ rice straw may be allowed to the extent of 15000 MTs and pulses straw to the extent of 10000 MT during current financial year i.e. 2000-2001.

(ii)      due to prevailing drought conditions in certain states, the purchase or procurement of fodder from the states of MP, Gujarat, Rajasthan and Orissa is prohibited. Applicant may submit a self-certificate in the form of affidavit in this regard.

(iii)      the exporters may apply for the export of above items within 15 days of issue of this circular to this office in prescribed form as given in Appendix 18A along with their profile in Form 1A of the Handbook of Procedure 1997-2002 (as amended upto 31.3.2000) (One exporter is entitled to one application only).

(iv)      applications should be accompanied by an export order or irrevocable letter of credit from the foreign buyer.

(v)       exporters who have already applied to this office during current financial year may not apply again. However, they may submit a certificate as mentioned in sub-para (ii) above.

(vi)      subject to ceiling as mentioned in Para 2(i) above, the overall licensing will be done on the basis of proportionate distribution to be decided by the Export Licensing Committee under DGFT.

3.     The applications for export licence for above items which were suspended due to the drought condition during the previous financial year 1999-2000 may be treated to have been rejected as the validity period of the licences have already expired and such cases would be treated as closed. However, they may apply afresh.
