Extension of time period for application in case of lost DEPB/ DFRC S/B, DE benefits for supplies to Nuclear Power project

Public Notice No. 57 dated 21st December 2001

In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II Section 3, Sub section (ii) vide S.O. No.283 (E) dated 31.03.1997, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol 1)(RE-01), 1997-2002.

1)      The last paragraph of para 7.51 is amended as under:

The claim against the lost Shipping Bill shall be made within a period of six months from the date of issuance of the duplicate copy of the shipping bill and any application received thereafter shall be rejected. Provided however that if a provisionally assessed DEPB shipping bill is lost, the time period for filing of application for DEPB would be 6 months from the date of release/ final assessment of the shipping bill.

(This amendment primarily extends the time period for the filing of application for DEPB/ DFRC in the case of lost EP copy of the shipping bill from �six months of the date of export� to �six months from the date of issuance of the duplicate copy of the shipping bill�)

2)      A new para 10.11 (B) is added as under:

Supply of goods required for setting up of any nuclear power project specified in List 35 to S.No. 370 of the Customs Notification No. 17 dated 01.03.2001 having a capacity of 440 MW or more, as certified by an officer not below the rank of Joint Secretary to the Government of India in the Department of Atomic Energy, shall be entitled for deemed export benefits in cases where the procedure of Competitive Bidding (and not International Competitive Bidding) has been followed.

The domestic supplier supplying to such nuclear power plants shall be entitled for the benefits listed in paragraph 10.3 (a), (b) and (c) of the Exim Policy, whichever is applicable.

         (This new para confers deemed export benefits to domestic supplies to specified nuclear power projects)

3)      The following sub para (g) is added in Appendix 14 A pertaining to the �Format of the Project Authority Certificate�

(g)       That supply of goods to specified nuclear power projects under the procedure of Competitive Bidding in made in accordance with the provisions of para 10.11(B) of Handbook of Procedures (Vol 1), 1997-2002 and the import content of the order is Rs. (Figures and words ________________)

         (This new para confers deemed export benefits to domestic supplies to specified nuclear power projects)

4)      The following sub para (vi) is added in Appendix 14 B pertaining to the �Format of Certificate of Payments issued by the Project Authority.

(vi)       Supply of goods to specified nuclear power projects under the procedure of Competitive Bidding in which the Ministry of Finance extends the benefits of deemed exports to domestic supplies.

         (This new para confers deemed export benefits to domestic supplies to specified nuclear power projects)
