HB Vol.1 amended - Deemed Export
Public Notice No. 45 dated 29th September 1997
In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3- Sub-section (ii) vide S.O. No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes following amendment in the Handbook of Procedures (Vol.1), 1997-2002.
7. The Paragraph 10.10 shall be renumbered as 10.10(a).
8. The following shall be added as sub-paragraph 10. 10(b):
"The benefit of deemed exports shall also be available to fertilizer plants which are set up or expanded/ revamped/ retrofitted/ modernised during the Ninth Plan provided such supplies are made under the procedure of International Competitive Bidding and price preference is not available to the supplier of capital goods and its spares to fertilizer plants."
9. The following shall be added as sub-paragraph (e) of Appendix -14A:
"That price preference is not available to the supplier of capital goods and its spares to fertilizer plants. (Applicable only for category 10.1 O (b) of Handbook of Procedures-Vol.1)"
10. In Appendix-14B sub paragraph (ii) of FORM I-A and sub paragraph 2(ii) of FORM I-B shall be amended to read as follows:
"Supply of capital goods to fertiliser plants if the supply is made under the procedure of international competitive bidding.
Further price preference is not available to the supplier of capital goods and its spares to fertilizer plants. (Applicable only for category 10.10(b) of Handbook of Procedures-Vol.1)"
11. In Appendix-14B the alternate sub paragraph appearing after the word 'OR' of paragraph 3 shall be amended to read as follows:
"It is further certified that the supplies have been made in terms of the contract secured against international competitive bidding in the project being undertaken by us and which has been (a) approved by the Department of Fertilizer vide their Reference No._________ dated_________; further price preference is not available to the supplier of capital goods and its spares to fertilizer plants. (Applicable only for category 10.1 O (b) of Handbook of Procedures Vol.1 or (b) notified vide Department of Economic Affairs, Ministry of Finance Reference No_________ dated__________ and the supplies have been accepted by us at site at the price stated in the invoice."
12. S.No. 3(c)(iii) of 'Documents to be enclosed with the application form: ' of Appendix 20C shall be deleted.
