Subject: Procedure for filing supplementary DEPBs as per DGFT Public Notice No.67 dated 21/6/2004

Reference of trade is invited to P.N. No.67 dt. 21/6/2004 according to which DEPB rates of entry at Sr.No.2 in the Fish & Fish Products have been enhanced to 5% w.e.f. 3/5/2003.

The following guidelines are issued for the benefit of applicants for applying to this office for supplementary DEPBs:-

1. Applications will be submitted to this office as per Annexure � A to this Trade Notice.

2. Applicants can submit three applications per day at the relevant advance licence/FAS counters from 11 a.m. to 12.30 p.m.. These applications will be in addition to normal three applications, which an applicant is allowed to file for DEPBs/Adv. Licence.

3. The applications may be filed in manual mode

4. The supplementary DEPBs will be issued within seven working days.

    1. I/We hereby declare that the particulars and the statements made in this application are true and correct to the best of my/our knowledge and belief and nothing has been concealed or held there from.

    2. I/We fully understand that any information furnished in the application if proved incorrect or false will render me/us liable for any penal action or other consequences as may be prescribed in law or otherwise warranted.

    3. I/We undertake to abide by the provisions of the Foreign Trade (Development and Regulation) Act, 1992, the Rules and Orders framed thereunder, the Export and Import Policy and the Handbook of Procedures.

    4. I/We hereby declare that no supplementary DEPB has been claimed on account of revised DEPB rates as per Public Notice No. 67 dated 21.6.2004 earlier pertaining to the file numbers mentioned. in column 5 of the application form. I/We also undertake that except for the present application no other application for supplementary claim for the shipments covered in column 2 of application will be made by us

    5. I/We further declare that no export proceeds are outstanding beyond the prescribed period as laid down by the RBI, or such extended period for which RBI permission has been obtained.

    6. I hereby certify that I am authorized to verify and sign this declaration as per Paragraph 9.9 of the Policy.

    7. I/We further declare that in case of non realization of export proceeds or lesser realization of export proceeds, we shall pay, in cash, an amount equivalent to the DEPB entitlement already obtained on the non realised or lesser realised value of export proceeds together with 15% interest reckoned from the date of duty free imports effected under DEPB to the date of payment.
