It
has been brought to the notice of the Board that the field formations are
initiating proceedings for recovery of money credit availed of by Vanaspati
Manufacturers under the Notification No. 45/89-CE (NT) dated 11.10.1989 on the
ground that the provisions of Section 11D of the Central Excises And Salt Act,
1944 are applicable to such cases.

I am directed to say that as the issue is presently under the examination
of the Board, you are requested to direct all Commissioners of Central Excise
under your jurisdiction not to take precipitative action to enforce such demands
pending decision of the Board.
