Import Licensing Notes



  1. An application for grant of a license for import of Animals, Birds and
    Reptiles (including their parts and products) may be made in the form given in
    Appendix - 8 of the Handbook of Procedures Vol. 1, to the Director General of
    Foreign Trade along with the recommendation of the Chief Wild Life Warden of the
    State concerned.




  2.  An application for grant of a license for import of Stallions and Broodmares may be made in the form given in Appendix - 8 of the Handbook of Procedures Vol. 1, to the Director General of Foreign Trade along with the recommendation of Director, Animal Husbandry and Veterinary Services of the State Government concerned or the Department of Animal Husbandry and Dairying, Ministry of Agriculture, Government of India. The import of stallions and broodmares against licenses shall be subject to the following conditions:




    (i) Import of such animals shall be subject to the health regulations in force;




    (ii) Applications shall be considered only from stud farms, which have been in existence for at least three years and registered with the Animal Husbandry Commissioner, Department of Agriculture and Cooperation, Government of India. However, this period of three years may be relaxed on merits;



    (iii) A certificate of fitness issued either by the veterinary officer or by a qualified veterinary doctor registered with the Government of the country of origin shall be furnished at the time of customs clearance.


    (iv) Importer shall furnish information on the age, sex and breed of horses as well as the purpose of import with supporting document at the time of filling application to the DGFT.



  3. An application for grant of Livestock (excluding equine), Pureline stocks,
    birds, eggs, frozen semen/embro and commercial chicks may be made in the form
    given in Appendix -8 of the Handbook of Procedure Vol. 1, to the Director
    General of Foreign Trade along with the recommendation of the Department of
    Agriculture and Cooperation, Government of India.




  4. Import of Live animals other than wild animal as defined under wild Life
    Protection Act 1972 is permitted against a license to Zoos and Zoological Parks,
    circus companies, private individuals, on the recommendation of the Chief Wild
    Life Warden of a State Government subject to the provisions of the Convention on
    Inter-national Trade in Endangered Species of Wild Fauna and Flora (CITES). For recognised scientific/research institutions, in addition to the above
    requirements, recommendation of Committee for the purpose of Control and
    Supervision of Experiments on Animals (CPCSEA) under the Prevention of Cruelty
    to Animals Act, 1960 shall also be required for issuance of Import License.




  5. Import of Wild Animals (including their parts and products) as defined in the
    Wild Life (Protection) Act, 1972 is prohibited and in respect to those species
    listed in CITES, is subject to the provisions of CITES.


Condition:

1. Condition 16 of Chapter 1 A (General Notes to Import Policy) of the ITC (HS)
Classifications of Export and Import items, 2004-09 shall be amended to read as
under: ( ref. By DGFT NOTIFICATION No. 30 (RE-2007)/2004-2009 Dated 24-09-2007)



16. Import into India of the following live-stock and live-stock products shall
be prohibited from all countries, in view of notifiable Avian Influenza (both
Highly Pathogenic notifiable Avian Influenza and Low Pathogenic notifiable Avian
Influenza) :

(a) domestic and wild birds (excluding poultry and captive birds);

(b) unprocessed meat and meat products from Avian species including wild birds
(except poultry);

(c) semen of domestic and wild birds.

Further, the Central Government also prohibits the import into India from the
countries reporting notifiable Avian Influenza (both Highly Pathogenic
notifiable Avian Influenza and Low Pathogenic notifiable Avian Influenza), the
following live-stock and live-stock products, namely:

(a) Live poultry and captive birds;

(b) day old chicks, ducks, turkey and other newly hatched Avian species;

(c) meat and meat products from Avian species including wild birds;

(d) hatching eggs;

(e) egg and egg products (except Specific Pathogen Free eggs);

(f) feathers;

(g) live pig and unprocessed pig products;

(h) pathological material and biological products from birds;

(i) product of animal origin (from birds) intended for use in animal feeding or
for agricultural or industrial use.

Provided that the prohibition shall not be applicable on the import of
pathological material and biological products for diagnostic and research
purposes from South Asian Association for Regional Cooperation member countries
on specific request.

Provided further that the prohibition shall also not be applicable on the import
of processed pet food containing the ingredient of meat and meat products from
avian species, pig and product of animal origin (from birds) intended for use in
animal feeding.

(vi) feathers;

(vii) live pig and pig products (including pig bristles);

(viii) pathological material and biological products from birds;

(ix) product of animal origin (from birds) intended for use in animal feeding or
for agricultural or industrial use.

However, the prohibition shall not be applicable on the import of dry processed
pet food containing the ingredient of meat and meat products from Avian species,
pig and product of animal origin (from birds) intended for use in animal
feeding.” ]
