In exercise of
powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002,
as notified in the Gazette of India extraordinary, Part-II Section 3, Sub
section (ii) vide S.O. No. 283(E) dated 31.03.1997, the Director General of
Foreign Trade hereby makes the following amendment in Handbook (Vol 1).(RE-01),
1997-2002.
The Central Board
of Excise and Customs (CBEC) has vide Notification No 10/2002 dated 21.01.2002
permitted the duty free imports of goods upto one percent of the FOB value of
exports during the preceding financial year specified in List 27A by units in
the Pharmaceutical and Biotechnology sectors having export turnover of Rs 20
Crores and above during the preceding licensing year if such importer has
Research and Development wing which is registered with the Department of
Scientific and Industrial Research in the Ministry of Science and Technology.
However the said
notification mandates the production of a certificate from the Joint Director
General of Foreign Trade in the Department of Commerce certifying the FOB value
of exports made during the preceding licensing year along with the value and
quantity of goods imported under Notification 10/2002 during the current
licensing year.
It is hereby
decided that under the procedure specified in Customs Notification 10/2002, the
Regional Licensing Authorities under whose jurisdiction the registered office of
company or Head Office of the firm is located may issue certificates as per
Appendix 60 attached to this Public Notice on receipt of a formal application
along with Appendix 1 A (in duplicate) from the respective applicants.
This issues in
public interest.

and Development purpose only.
b) We/ I hereby undertake that the total value of goods imported during
2001-2002 under Customs Notification No 10/2002 will not exceed 1 % of the FOB
value of exports in the financial year 2000-2001.
c) We/ I hereby undertake that the imported goods would be installed in the
said Research and Development Wing of the importer within 6 months of the date
of importation. These goods would not be transferred or sold for a period of 7
years from the date of installation.
d) We/ I hereby declare that the imports by the unit are for Research and
Development in the Pharmaceutical and Biotechnology sectors.
e) We/ I hereby declare that the Research and Development wing of the unit
which has undertaken these imports is registered with the Department of Science
and Industrial Research in the Ministry of Science and Technology of the
Government of India.

that the above statements are true and correct and nothing has been concealed or
held therefrom. We/ I fully understand that any information furnished if proved
incorrect or false will render us/ me liable for penal action and other
consequences as may be prescribed in the FTDR Act 1992, Foreign Trade Regulation
Rules, 1993 and Orders framed thereunder, and any other law in force.
