Subject:- Exemption of Bhutan from the application of export bans by India on export of Milk Powder, Wheat, Edible Oils, Pulses and Non Basmati Rice.

S.O. (E) In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992) read with paragraph 2.1 of the Foreign Trade Policy, 2009-2014, as amended from time to time, the Central Government hereby amends Notification No. 87(Re-2010)/2009-14 dated 05.12.2011 as follows.

  1. As per Notification No. 87(RE-2010)/2009-14 dated 05.12.2011, export of following items to Bhutan was exempted from any export ban with the annual limits indicated against each:
  1. Milk powder : 1,600 Metric Tonnes

  2. Wheat : 24,000 Metric Tonnes

  3. Edible oil : 2,400 Metric Tonnes

  4. Pulses : 1,200 Metric Tonnes

  5. Non-basmati rice : 21,200 Metric Tonnes

This notification did not elaborate whether the “annual limit” will be counted Financial Year wise (and if so whether it will be Financial Year of India or of Bhutan) or Calendar Year wise.

  1. It is notified hereby that “annual” will refer to Calendar Year. Thus the limit would be for the period 1st January to 31st December of every year.

  2. Effect of this Notification:

The annual limit for export of above items to Bhutan will be as per Calendar Year i.e. from 1st January to 31st December.
