Subject: Filing of application under E-Com and Physical Format- Clarification
regarding last date of application for benefit under VKGUY, FMS and FPS.
- Representations have been received from Regional Authorities and from Trade
seeking clarification whether an application filed through E-com by the last
date of application, but where the physical application along with relevant
documents was received in Regional Authority only after the last date, can be
considered as an application filed on time and whether DFCE can be issued
without late cut. Also clarification has been sought whether an application
submitted after the last date of application (i.e. after 30.9.2006 for VKGUY
Scheme) can be considered under Para 9.3 of Hand Book of Procedure with late cut
of 10% on entitlement.
- The matter has been examined and it is clarified that an application filed
through E-com by the last date of application for the above schemes shall be
considered as an application on time. However, the applicant is required to
submit application in Physical Format along with relevant documents after filing
of application in E-Com within 7 working days to the concerned Regional
Authority.
- Regarding issue whether an application for benefit under Export Promotion
Schemes which is submitted after the last date of application can be considered
under Para 9.3 of Hand Book of Procedure with late cut of 10% on entitlement, it
is clarified that Para 9.3 is general in nature and this is applicable to all
schemes unless and until it is stated otherwise in Policy/ Procedure. Hence the
applications received by Regional Authorities for benefit under the above
schemes after last date but within six months from the last date of the
application shall be processed by imposing 10% late cut in entitlement in tune
with Para 9.3 of Hand Book of Procedure.
- This issues with the approval of Director General of Foreign Trade on file.
