NOTIFICATION No. 05/2021-CUSTOMS (ADD)
New Delhi, the 1st February, 2021
G.S.R. (E). – Whereas, in the matter of import of
„Straight Length Bars and Rods of Alloy Steel‟(hereinafter referred to as the
subject goods), falling under heading 7228 of the First Schedule to theCustoms
Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff
Act) originating in or exported from People‟s Republic of China (hereinafter
referred to as the subject country) and imported into India, the designated
authority in its final findings vide notification No. 6/10/2017 -DGAD, dated the
5th September, 2018, published in the Gazette of India, Extraordinary, Part I,
Section1, dated the 5th September, 2018, had recommended imposition of
definitive anti-dumping duty on the imports of subject goods, originating in
or exported from the subject country;
And
whereas, on the basis of aforesaid findings of the designated authority, the
Central Government had imposed definitive anti-dumping duty on the subject
goods vide notification of the Government of India in the Ministry of Finance
(Department of Revenue),No. 54/2018-Customs (ADD),dated the 18th October,
2018, published in the Gazette of India, Extraordinary, Part II, Section 3,
Subsection (i) vide number G. S. R. 1045 (E), dated the 18th October, 2018
(hereinafter referred to as the said notification);
Now, therefore, in
exercise of the powers conferred by sub-sections (1) and (5) of section 9A of
the Customs Tariff Act, read with rules 18 and 20 of the Customs Tariff
(Identification, Assessment and Collection of Anti-dumping Duty on Dumped
Articles and for Determination of Injury) Rules, 1995, the Central Government
hereby makes the following amendments in the said notification, namely:-
In
the said notification, in paragraph 2 and before the Explanation, the following
proviso shall be inserted with effect from the 2nd day of February, 2021,
namely :-
“Provided that the said anti-dumping duty shall not be levied for
the period commencing from the 2nd day of February, 2021 to the 30th day of
September, 2021.”.
